§ 39:5-5.

All proceedings for the violation of this subtitle shall be brought in the name of

the State, with the director, police officer, peace officer, or any other person who institutes the proceedings as prosecutor. A judge may, at his discretion, refuse to issue a warrant on the complaint of a

person other than the director or a police officer, until a sufficient bond to secure

costs has been executed and delivered to the judge.
