§ 13:18a-40.
a. Following the 31st day of a default on any loan secured, in whole or in part, by
a pinelands development credit guarantee, the lender shall send notice by certified
mail to the applicant and the board, stating the consequences of his default. The applicant and the lender may, within 90 days of the initial default, agree to
take any reasonable steps to assure the fulfillment of the loan obligation. b. In the event the applicant and the lender have not made arrangements for the continuation
of the loan obligation within 90 days of the initial default, the lender shall file
a claim with the board, identifying the loan and the nature of the default and shall:
(1) assign the security interest in the pinelands development credit to the board
in exchange for payment according to the terms of pinelands development credit guarantee;
or (2) retain the security interest in the pinelands development credit and waive
any claim to payment pursuant to the terms of the pinelands development credit guarantee.
