§ 436-74. Section 436:74 Penalty.
I. Any person who, knowing or having reason to believe that any horse is infected with glanders, or that any swine is infected with hog cholera, or that any domestic animal is infected with anthrax or black leg, hemorrhagic septicemia, contagious infectious abortion, or any other contagious or infectious disease, shall sell, offer for sale, trade or barter, or expose or allow it to be exposed upon any public highway or in any public place, without the written permission of the commissioner or his agent, shall be guilty of a misdemeanor. II. In addition, any person who violates any of the provisions of this subdivision or rules adopted under it may be subject to an administrative fine levied by the commissioner, not to exceed $1,000 for each violation.
