§ 281A.540. Governmental grant, contract or lease and certain actions taken in violation of chapter are voidable; prohibited contract is void; recovery of benefit received as result of violation
1. In addition to any other penalties provided by law, a governmental grant, contract
or lease entered into in violation of this chapter is voidable by the State, county,
city or political subdivision. In a determination under this section of whether to void a grant, contract or lease,
the interests of innocent third parties who could be damaged must be taken into account. The Attorney General, district attorney or city attorney must give notice of the
intent to void a grant, contract or lease under this section no later than 30 days
after the Commission has determined that there has been a related violation of this
chapter. 2. In addition to any other penalties provided by law, a contract prohibited by NRS 281.230 which is knowingly entered into by a person designated in subsection 1 of NRS 281.230 is void. 3. Any action taken by the State in violation of this chapter is voidable, except
that the interests of innocent third parties in the nature of the violation must be
taken into account. The Attorney General may also pursue any other available legal or equitable remedies. 4. In addition to any other penalties provided by law, the Attorney General may recover
any fee, compensation, gift or benefit received by a person as a result of a violation
of this chapter by a public officer. An action to recover pursuant to this section must be brought within 2 years after
the violation or reasonable discovery of the violation.
