§ 266.044. Apportionment of county's fixed assets located within city

1. The governing body of the incorporated city and the board of county commissioners

of the county in which the incorporated city is located shall, before the date the

incorporation becomes effective or within 90 days thereafter, equitably apportion

those fixed assets of the county which are located within the boundaries of the incorporated

city. The governing bodies shall consider the location, use and types of assets in determining

an equitable apportionment between the county and the incorporated city. 2. Any real property and its appurtenances located within the incorporated city and

not required for the efficient operation of the county's duties must first be applied

toward the city's share of the assets of the county. Any real property which is required by the county for the efficient operation of its

duties must not be transferred to the city. 3. If an agreement to apportion the assets of the county is not reached within 90

days after the incorporation of the city, the matter may be submitted to arbitration

upon the motion of either party. 4. Any appeal of the arbitration award must be filed with the district court within

30 days after the award is granted.
