§ 179.335. Motion for return of seized property and suppression of evidence
A motion for the return of seized property and the suppression of evidence may be
in substantially the following form: MOTION FOR THE RETURN OF SEIZED PROPERTY AND THE SUPPRESSION OF EVIDENCE Defendant (naming defendant) hereby moves this court to direct that certain property
of which the defendant is the owner, a schedule of which is annexed hereto, and which
on (stating date and time), at (describing the place), was unlawfully seized and taken
from the defendant by a peace officer of the State of Nevada (name and designation
of peace officer, or, if so, state “whose true name is unknown to the petitioner”),
be returned and that it be suppressed as evidence against the defendant in any criminal
proceeding. The petitioner further states that the property was seized against his or her will
and without a search warrant (or other reason why the warrant is defective or illegal).
