§ 49-4-604. Enforcement

Enforcement. (1) A person claiming to be aggrieved by a violation of any provision of this part may file a civil action for injunctive and other equitable relief against the covered entity in the district court for the county where the affected person resides or the county where the alleged violation occurred. (2) In an action brought under this part, the court may grant injunctive or other equitable relief, including: (a) requiring auxiliary aids or services to be made available for the recipient; (b) requiring the modification of a policy, practice, or procedure of a covered entity; or (c) requiring facilities to be made accessible to and usable by a qualified recipient. (3) The court shall give priority on its docket and an expedited review. (4) Nothing in this part is intended to limit or replace other remedies available under federal or other law. (5) This part does not create a right to compensatory or punitive damages against a covered entity.
