§ 339.1021. Type B personnel agency; prohibited acts.

Sec. 1021.

A type B personnel agency shall not do any of the following:

(a)

Put a client in direct contact with a specific employer.

(b)

Contact a specific employer on behalf of a client.

(c)

Advertise the availability of an individual for employment.

(d)

Charge or accept a fee from a client at the time a client procures employment.

(e)

Provide clients with lists of potential employers, if the type B personnel agency chooses to provide such lists in compliance with section 1015, without providing additional consulting services.

(f)

Advertise, including in directories or news media, that it is an employment agency or in such a manner that may lead a client or potential client to believe that the type B personnel agency or any of its agents or employees may, in any way, put a client in direct contact with an employer.
