§ 22-12-2-10. Transfer of powers and duties

Sec. 10. (a) On July 1, 2019, all powers, duties, agreements, and liabilities of the regulated amusement device safety board are transferred to the commission, as the successor agency.
(b) On July 1, 2019, all records and property of the regulated amusement device safety board, including appropriations and other funds under the control or supervision of the regulated amusement device safety board, are transferred to the commission, as the successor agency.
(c) After June 30, 2019, any amounts owed to the regulated amusement device safety board before July 1, 2019, are considered to be owed to the commission as the successor agency.
(d) After June 30, 2019, a reference to the regulated amusement device safety board in a statute, rule, or other document is considered a reference to the commission, as the successor agency.
(e) Proceedings pending before the regulated amusement device safety board on July 1, 2019, shall be transferred from the regulated amusement device safety board to the commission and treated as if initiated by the commission.
(f) The rules adopted by the regulated amusement device safety board before July 1, 2019, concerning regulated amusement device safety are considered, after June 30, 2019, rules of the commission.

Sec. 1. (a) On July 1, 2027, all powers, duties, agreements, and liabilities of the fire prevention and building safety commission are transferred to the department.
(b) On July 1, 2027, all records and property of the fire prevention and building safety commission, including appropriations and other funds under the control or supervision of the fire prevention and building safety commission, are transferred to the department.
(c) After June 30, 2027, any amounts owed to the fire prevention and building safety commission before July 1, 2027, are considered to be owed to the department as the successor agency.
(d) After June 30, 2027, a reference to the fire prevention and building safety commission in a statute, rule, or other document is considered a reference to the department.
(e) Proceedings pending before the fire prevention and building safety commission on July 1, 2027, shall be transferred from the fire prevention and building safety commission to the department and treated as if initiated by the department.
(f) A license or permit issued by the fire prevention and building safety commission before July 1, 2027, shall be treated after June 30, 2027, as a certification issued by the department.
(g) The rules adopted by the fire prevention and building safety commission before July 1, 2027, are considered, after June 30, 2027, rules of the department. For purposes of applying IC 4-22-2.6 to the readoption of rules transferred by this subsection, the rules shall be treated as not expiring. Except as permitted under IC 4-22-2-38 to make nonsubstantive technical corrections, the department may not revise or repeal the transferred rules, including matters incorporated by reference, unless authorized by act of the general assembly.
(h) Not later than July 1, 2028, and each year thereafter, the department shall submit a report to the legislative council in an electronic format under IC 5-14-6 making recommendations for amendment of the rules of the fire prevention and building safety commission transferred to the department under this section. The legislative council shall assign the report to be reviewed by an interim study committee established under IC 2-5-1.3. In preparing the report required by this subsection, the department shall consult with industry experts, professionals, and interested stakeholders who have indicated an interest in the subject matter of the recommendations contained in the report.

Sec. 2. Rules adopted under IC 4-22-2 relating to building codes may not take effect earlier than one hundred eighty (180) days after the final rule is filed with the publisher unless required by law or to maintain compliance with a federal program.

Sec. 3. The commission shall decide which building codes shall be reviewed each calendar year, focusing on the oldest building codes for review. Except as permitted under section 4(b) of this chapter, the commission may not adopt a final rule under IC 4-22-2-29 for more than three (3) building codes during any twelve (12) month period.

Sec. 4. (a) The commission may not review and update a building code to a new edition earlier than five (5) years after the building code's effective date.
(b) Notwithstanding subsection (a), the commission may consider an amendment to a building code not under consideration during the current year in any the following circumstances:
(1) The amendment resolves a conflict with another building code.
(2) The amendment addresses an emergency or some other exigent circumstance.
(3) A county, city, or town submits a proposed amendment to the commission under IC 22-13-2-5.6.

Sec. 5. (a) This section does not apply to either of the following adopted by a unit:
(1) The unit's architectural design standards.
(2) The unit's zoning ordinances.
(b) A unit (as defined in IC 36-1-2-23) may not adopt an ordinance concerning construction and remodeling that:
(1) conflicts with this chapter or a code adopted under this chapter; or
(2) includes more stringent or detailed requirements than those set forth in this chapter or a code adopted under this chapter.
If a building code or standard within the jurisdiction of the commission is silent on equipment or a regulation, a unit may petition the commission for consideration and a determination.
