§ 16-46-7-10. Study
Sec. 10. (a) Before July 1, 2019, and on a biennial basis thereafter, the state department, with the assistance of:
(1) the Indiana minority health coalition;
(2) health care providers that treat individuals with sickle cell disease;
(3) individuals diagnosed with sickle cell disease; and
(4) representatives of community based organizations that serve individuals with sickle cell disease;
shall perform a study to determine the prevalence, impact, and needs of individuals with sickle cell disease and sickle cell trait in Indiana.
(b) The study must include the following:
(1) The prevalence, by geographic location, of individuals diagnosed with sickle cell disease in Indiana.
(2) The prevalence, by geographic location, of individuals diagnosed as sickle cell trait carriers in Indiana.
(3) The availability and affordability of screening services in Indiana for sickle cell trait.
(4) The location and capacity of the following for the treatment of sickle cell disease and sickle cell trait carriers:
(A) Treatment centers.
(B) Clinics.
(C) Community based social service organizations.
(D) Medical specialists.
(5) The unmet medical, psychological, and social needs encountered by individuals in Indiana with sickle cell disease.
(6) The underserved areas of Indiana for the treatment of sickle cell disease.
(7) Recommendations for actions to address any shortcomings in Indiana identified under this section.
(c) The state department shall make information from a study performed under this section available on the state department's website.

IC 16-46-7.5-1Pediatric cancer research and treatment grant program Sec. 1. The pediatric cancer research and treatment grant program may be established. The state department shall administer the program.

IC 16-46-7.5-2Establishment of fund; source of funding; administration Sec. 2. (a) The pediatric cancer research and treatment fund is established for the purpose of providing matching funds for medical research and treatment grants that focus on pediatric cancer research.
(b) The fund consists of:
(1) money received from state or federal grants or programs; and
(2) gifts, money, and donations received from any other source.
(c) The state department shall administer the fund. The expenses of administering the fund shall be paid from money in the fund.
(d) The treasurer of state shall invest the money in the fund not currently needed to meet the obligations of the fund in the same manner as other public money may be invested.
(e) Money in the fund at the end of a state fiscal year does not revert to the state general fund.
(f) Money in the fund is continuously appropriated for the purposes of the fund.

IC 16-46-7.5-3Powers of the state department Sec. 3. (a) The state department may do the following:
(1) Develop the application and the criteria and standards of eligibility for entities described in subsection (b) that apply for a grant under this chapter.
(2) Establish criteria for determining the grant amount to be awarded to an approved applicant and the terms of an awarded grant, including placing a priority on providing grants for the following:
(A) Innovative research and treatments with the potential of resulting in novel therapies for pediatric cancer.
(B) Research and treatment identified by the state department as part of the state department's needs assessment under subdivision (6)(B) to address the state's highest needs concerning pediatric cancer in Indiana children.
(3) Determine policies for the expiration and renewal of a grant.
(4) Require that all grant funds be used for the purpose of research and treatment with the purpose of combating childhood cancer.
(5) Develop procedures in ensuring that funds provided through a grant are expended for the stated purpose.
(6) Develop a written plan to assist in making determinations concerning grants under this chapter that does the following:
(A) Identifies existing pediatric cancer research, treatment, and funding programs for pediatric cancer in Indiana and those that provide assistance to children in Indiana diagnosed with cancer.
(B) Includes a needs assessment for pediatric cancer patients of Indiana identifying additional research funding needs by cancer type and geographic area, with documentation of any determination that support is needed.
(C) Includes a prioritized list of programs and research projects eligible for assistance under this chapter.
(7) Adopt administrative rules under IC 4-22-2 necessary for the administration of this chapter.
(b) The state department may only award a grant under this chapter to any of the following entities that specialize in performing research and treatment in Indiana concerning pediatric cancer for Indiana children:
(1) An Indiana institution of higher education.
(2) An Indiana academic medical center or medical research hospital.
(3) An Indiana nonprofit entity.
(4) An Indiana governmental entity.

IC 16-46-7.5-4Annual report Sec. 4. (a) Before February 1 of each year, the state department shall submit a written report to the governor and to the legislative council in an electronic format under IC 5-14-6 that includes the following:
(1) The plan developed under section 3(a)(6) of this chapter.
(2) The state department's determination about any expenditure of funds under this chapter for the previous calendar year and the impact of the use of the funds.
(3) The state department's plans for expenditures of funds under this chapter in the current and subsequent calendar year.
(4) Any recommendations for future initiatives or actions to address pediatric cancer in Indiana.
(b) The state department shall publish the written report required by subsection (a) on the state department's website.

IC 16-46-7.6Chapter 7.6. Breast Cancer Research Grant Program

IC 16-46-7.6-1"Cancer center" Sec. 1. As used in this chapter, "cancer center" means one (1) of the following:
(1) An institution that has been designated by the National Cancer Institute as a:
(A) comprehensive cancer center;
(B) clinical cancer center; or
(C) basic laboratory cancer center.
(2) A cancer research facility that is formally part of an approved postsecondary educational institution (as defined in IC 21-7-13-6(b)).

IC 16-46-7.6-2"Fund" Sec. 2. As used in this chapter, "fund" refers to the breast cancer research fund established by section 7 of this chapter.

IC 16-46-7.6-4Grant program Sec. 4. The state department may establish a program for the purpose of providing grants to cancer centers in Indiana to increase:
(1) breast cancer research projects; or
(2) breast cancer clinical trials.

IC 16-46-7.6-5Powers of the state department Sec. 5. The state department may do the following:
(1) Develop the application criteria and standards for eligibility for cancer centers that apply for grants under the program.
(2) Make available grants to cancer centers that meet the eligibility standards developed under subdivision (1). However, the state department shall prioritize grants to cancer centers in the following order:
(A) A cancer center described in section 1(1) of this chapter.
(B) A cancer center described in section 1(2) of this chapter.
(3) Determine the maximum amount available for each grant.
(4) Determine policies for the expiration and renewal of grants.
(5) Require that each grant be used for the purpose of breast cancer research.
(6) Adopt rules under IC 4-22-2 necessary to implement this chapter.

(d) The treasurer of state shall invest the money in the fund not currently needed to meet the obligations of the fund in the same manner as other public money may be invested.
(e) Money in the fund at the end of a state fiscal year does not revert to the state general fund.
(f) Money in the fund is continuously appropriated for the purposes of the fund.
