§ 13-18-10-6. Violations; penalties

Sec. 6. A person who violates this chapter is subject to the penalties imposed by the following:

(1) IC 13-30-4.

(2) IC 13-30-5.

(3) IC 13-30-8.

In addition, a person who violates this chapter may be subject to criminal prosecution under IC 13-30-10.

IC 13-18-10.5Chapter 10.5. Satellite Manure Storage Structures

IC 13-18-10.5-1Department approval Sec. 1. A person may not after June 30, 2011, start:

(1) construction of a satellite manure storage structure; or

(2) expansion of a satellite manure storage structure that increases manure containment capacity;

without obtaining the prior approval of the department.

IC 13-18-10.5-2Rules Sec. 2. The board may adopt rules under IC 4-22-2 and IC 13-14-9 regarding the construction, operation, and maintenance of a satellite manure storage structure.

IC 13-18-10.5-3Applying for approval to construct or expand satellite manure storage structure Sec. 3. (a) An applicant who applies for approval under section 1 of this chapter to construct or expand a satellite manure storage structure shall make a reasonable effort to provide notice not more than ten (10) working days after submitting an application for approval to:

(1) the county executive of the county in which the satellite manure storage structure is to be constructed or expanded; and

(2) each owner and each occupant of land of which any part of the boundary is one-half (1/2) mile or less from any part of the proposed footprint of the satellite manure storage structure.

(b) The notice described in subsection (a) must:

(1) be in writing;

(2) be sent by mail; and

(3) include the following:

(A) The date the application was submitted to the department.

(B) A brief description of the subject of the application.

(c) An applicant shall pay the costs of complying with this section.

IC 13-18-10.7Chapter 10.7. Inspection of Confined Feeding Operations

IC 13-18-10.7-1Onsite inspection of feeding operation Sec. 1. Subject to section 2 of this chapter, the department shall conduct an onsite inspection of a confined feeding operation:

(1) once within ninety (90) days after receipt of the construction or expansion affidavit required by IC 13-18-10-2.2; and

(2) not:

(A) earlier than forty-five (45) days before; or

(B) later than forty-five (45) days after;

a renewal of an approval under IC 13-18-10;

to verify compliance with the terms and conditions of the approval. However, the department may delay an onsite inspection under this section if the department determines that additional time is needed to comply with the biosecurity procedures developed under section 5 of this chapter. The department may conduct additional onsite inspections at its discretion.

IC 13-18-10.7-2Complaint based onsite inspection Sec. 2. The department may conduct complaint based onsite inspections of a confined feeding operation at the department's discretion. A complaint based onsite inspection of a confined feeding operation is not subject to the thirty (30) day prior notification requirements under section 3 of this chapter.

IC 13-18-10.7-3Notice Sec. 3. The department shall notify the operator of a confined feeding operation of the date on which the department intends to conduct an onsite inspection under this chapter. The department shall provide notification under this section at least thirty (30) days before the intended date of the inspection. The confined feeding operation may waive notice under this section.

IC 13-18-10.7-4Duty to present credentials Sec. 4. Upon arriving at a confined feeding operation to conduct an onsite inspection, the officer, employee, or authorized representative of the department shall, if possible, present the credentials of the officer, employee, or authorized representative for inspection by the operator of the confined feeding operation or an employee or agent of the operator.

IC 13-18-10.7-5Requirements for inspections Sec. 5. An onsite inspection of a confined feeding operation must be conducted in compliance with:

(1) 327 IAC 19-4-1;

(2) biosecurity procedures developed by the department in consultation with the:

(A) Indiana state board of animal health; and

(B) United States Environmental Protection Agency; and

(3) reasonable site-specific biosecurity protocols for the confined feeding operation.
