§ 2-5-47-8. Providing data, documents, and information to task force

Sec. 8. The following shall provide the task force the data, documents, and other information that the task force deems necessary to perform the task force's duties under section 7 of this chapter:

(1) The office of the secretary of family and social services.

(2) The Indiana department of health.

(3) The department of insurance.

IC 2-5-53.5-1"Task force" Sec. 1. As used in this chapter, "task force" refers to the agricultural promotion and regulation task force established by section 2 of this chapter.

IC 2-5-53.5-2Establishment of task force Sec. 2. The agricultural promotion and regulation task force is established as a temporary task force which serves the general assembly. The task force shall operate under IC 2-5-1.2.

IC 2-5-53.5-3Task force membership Sec. 3. (a) The task force consists of the following sixteen (16) voting members and two (2) nonvoting members:

(1) Two (2) voting members of the senate appointed by the president pro tempore of the senate. However, one (1) member must include the chairperson of the senate agriculture committee.

(2) One (1) voting member of the senate appointed by the minority leader of the senate.

(3) Two (2) voting members of the house appointed by the speaker of the house of representatives. However, one (1) member must include the chairperson of the house agriculture and rural affairs committee.

(4) One (1) voting member of the house of representatives appointed by the minority leader of the house of representatives.

(5) The dean of the Purdue University School of Agriculture or the dean's designee, who is a voting member.

(6) The dean of the College of Veterinary Medicine of Purdue University or the dean's designee, who is a voting member.

(7) Eight (8) voting members appointed by the governor as follows:

(A) One (1) member representing the Indiana Farm Bureau, Inc.

(B) One (1) member representing the Agribusiness Council of Indiana.

(C) One (1) member engaged in poultry production.

(D) One (1) member engaged in dairying.

(E) One (1) member engaged in swine production.

(F) One (1) member engaged in beef-type cattle production.

(G) One (1) member engaged in corn production.

(H) One (1) member engaged in soybean production.

(8) The director of the Indiana state department of agriculture who serves ex officio and is a nonvoting member.

(9) The governor's senior policy adviser, or the adviser's designee, who is a nonvoting member.

(b) The members appointed under subsection (a) serve at the pleasure of the appointing authority.

IC 2-5-53.5-4Appointment of chairperson Sec. 4. The legislative council shall appoint either the chairperson of the senate agriculture committee or the chairperson of the house agriculture and rural affairs committee as the chairperson of the task force for the duration of the task force.

IC 2-5-53.5-5Vacancies Sec. 5. A vacancy on the task force shall be filled by the appointing authority.

IC 2-5-53.5-6Quorum Sec. 6. Nine (9) voting members of the task force constitute a quorum.

IC 2-5-53.5-7Voting requirements Sec. 7. The affirmative vote of a majority of the voting members appointed to the task force is required for the task force to take action on any measure, including final reports.

IC 2-5-53.5-8Meetings Sec. 8. The task force shall meet at least four (4) times. A meeting of the task force shall be called by the chairperson.

IC 2-5-53.5-9Duties of the task force Sec. 9. (a) The task force shall study the following:

(1) Whether changing the Indiana state department of agriculture into a regulatory agency compromises the department's advocacy role for the agriculture industry.

(2) Whether changes are needed:

(A) to the Indiana state department of agriculture; or

(B) to any other state entity that:

(i) promotes;

(ii) regulates; or

(iii) provides advice concerning;

agriculture in Indiana;

to improve the state's future promotional and regulatory functions in the agricultural industry.

(3) Current and future challenges and opportunities in the agricultural industry.

(4) The interrelationship of all agricultural state entities, including any informational or regulatory gaps or overlaps between the state entities.

(b) If the task force determines that the transfer of administration and functions of a state entity from Purdue University is appropriate, the task force shall study the following:

(1) Whether employment issues will arise from transferring administration, employees, or functions of a state entity described in this subsection from Purdue University to another state entity.

(2) Whether issues will arise from the transfer of any:

(A) property;

(B) records;

(C) funds; or

(D) accounts;

from Purdue University to another state entity.

(3) The feasibility of transferring administration and functions of the state entities described in this subsection from Purdue University to another state entity.

IC 2-5-53.5-10Requesting and receiving information Sec. 10. The task force shall request information and testimony from:

(1) agricultural associations, organizations, and businesses; and

(2) heads or designees of state entities that:

(A) promote;

(B) regulate; or

(C) provide advice concerning;

agriculture in Indiana.

IC 2-5-53.5-11Task force report Sec. 11. The task force shall:

(1) develop recommendations in a report concerning the issues set forth in section 9 of this chapter; and

(2) submit the report to the legislative council in an electronic format under IC 5-14-6 not later than November 1, 2026.

IC 2-5-53.5-12Staff support Sec. 12. The legislative services agency shall staff the task force.

IC 2-5-53.5-13Per diem, mileage, and expense reimbursement Sec. 13. (a) Each member of the task force who is not a state employee is entitled to receive the same per diem, mileage, and travel allowances paid to individuals who serve as legislative and lay members, respectively, of interim study committees established by the legislative council.

(b) Each member of the task force who is a state employee is entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency.

(c) Each member of the task force who is a member of the general assembly is entitled to receive the same per diem, mileage, and travel allowances paid to members of the general assembly serving on interim study committees established by the legislative council.

(d) Per diem, mileage, and travel allowances paid under this chapter shall be paid from appropriations made to the legislative council or the legislative services agency.

IC 2-5-53.7-3"Task force" Sec. 3. As used in this chapter, "task force" refers to the artificial intelligence task force established by section 4 of this chapter.

IC 2-5-53.7-4Artificial intelligence task force established Sec. 4. The artificial intelligence task force is established as a temporary task force serving the general assembly.

IC 2-5-53.7-5Task force membership; appointment; terms Sec. 5. (a) The task force consists of the following fifteen (15) members:

(1) A member of the house of representatives who is appointed to the task force by the speaker of the house of representatives.

(2) A member of the senate who is appointed to the task force by the president pro tempore of the senate.

(3) A member of the house of representatives who is appointed to the task force by the minority leader of the house of representatives.

(4) A member of the senate who is appointed to the task force by the minority leader of the senate.

(5) The chief information officer appointed under IC 4-13.1-2-3, who serves as an ex officio member of the task force.

(6) The chief data officer appointed under IC 4-3-26-9, who serves as an ex officio member of the task force, or the chief data officer's designee.

(7) The following members who are appointed to the task force by the governor:

(A) An academic professional who:

(i) is employed by a public or private college or university located in Indiana; and

(ii) specializes in ethics.

(B) An academic professional who:

(i) is employed by a public or private college or university located in Indiana; and

(ii) specializes in artificial intelligence technology.

(C) An individual with expertise in the use of artificial intelligence by law enforcement agencies.

(D) An individual with expertise in legal and constitutional rights.

(E) An individual employed in the cloud technology industry.

(8) A member with expertise in artificial intelligence or cybersecurity who is appointed to the task force as follows:

(A) The president pro tempore of the senate shall appoint the member in odd-numbered years.

(B) The speaker of the house of representatives shall appoint the member in even-numbered years.

(9) The solicitor general, who serves as an ex officio member of the task force, or the solicitor general's designee.

(10) The director of information technology of the senate, who serves as an ex officio member of the task force.

(11) The director of the legislative services agency's office of technology services, who serves as an ex officio member of the task force.

(b) The members appointed under subsection (a)(1) and (a)(2) shall serve as co-chairs of the task force.

(c) Members of the task force appointed to the task force under subsection (a)(1), (a)(2), (a)(3), (a)(4), (a)(7), and (a)(8) serve a term that ends June 30 of each odd-numbered year but may be reappointed to subsequent terms.

(d) If a vacancy occurs on the task force, the appointing authority who appointed the member whose position is vacant shall appoint an individual to fill the vacancy.

(e) An individual appointed to fill a vacancy must meet the qualifications of the vacancy.

(f) An individual appointed to fill a vacancy serves for the remainder of the term of the member the individual is appointed to replace.

(g) The following shall serve as nonvoting members of the task force:

(1) The chief information officer.

(2) The chief data officer, or the chief data officer's designee.

(h) Appointing authorities shall appoint the initial members of the task force under subsection (a)(1), (a)(2), (a)(3), (a)(4), (a)(7), and (a)(8) not later than August 1, 2024, and not later than August 1 of each odd-numbered year thereafter.

IC 2-5-53.7-6Task force meetings; public access to task force records Sec. 6. (a) The task force shall meet at the call of the co-chairs.

(b) The task force shall meet for the first time not later than September 1, 2024.

(c) A majority of the members of the task force constitutes a quorum.

(d) The affirmative votes of a majority of the voting members of the task force are required for the task force to take action on any measure, including adoption of the report under section 8(3) of this chapter.

(e) All meetings of the task force are open to the public in accordance with and subject to IC 5-14-1.5. All records of the task force are subject to the requirements of IC 5-14-3.

IC 2-5-53.7-7Legislative services agency staffing Sec. 7. (a) The legislative services agency shall staff the task force.

(b) Except as otherwise provided in this chapter, the task force is subject to IC 2-5-1.2 and the policies and rules of the legislative council.

IC 2-5-53.7-8Task force duties; study; report Sec. 8. The task force shall do the following:

(1) Conduct a study of:

(A) artificial intelligence technology that has been used, developed, or considered for use by state agencies as reported under IC 4-13.1-5; and

(B) recommendations issued by other state, institutional, or academic bodies regarding use of artificial intelligence technology in government.

(2) Assess documented and potential:

(A) benefits and risks to state agencies of state agency use of artificial intelligence technology; and

(B) effects of state agency use of artificial intelligence technology on the rights and interests of Indiana residents, including on the:

(i) constitutional and legal rights;

(ii) privacy interests;

(iii) employment; and

(iv) economic welfare;

of Indiana residents.

(3) Not later than October 31, 2024, and not later than October 31 of each year thereafter, adopt and submit to the executive director of the legislative services agency, for distribution to the members of the general assembly, a report that includes the following:

(A) The results of the task force's study under subdivision (1) and assessment under subdivision (2).

(B) The task force's recommendations with regard to state policies, including any recommended legislation, governing state agency use of artificial intelligence technology, including any policies or legislation necessary to:

(i) promote effective, informed, and beneficial use of artificial intelligence technology by state agencies; and

(ii) protect the rights and interests of state residents, including the rights and interests described in subdivision (2)(B), from infringement or impairment by state agency use of artificial intelligence technology.
