§ 3.16.
Offsite Areas. (a) Offsite areas shall be protected from slides or damage occurring during surface mining and reclamation operations. (b) Surface mining operations that remove and do not replace the lateral support shall not, unless mutually agreed on by the operator and the adjacent property owner, approach property lines or established right-of-way lines of any public roads, streets, or highways closer than a distance equal to 10 feet plus one and one-half times the depth of the excavation except where consolidated material or materials of sufficient hardness or ability to resist weathering and to inhibit erosion or sloughing exist in the highwall, the distance from the property line or any established right-of way line shall not, unless mutually agreed, be closer than a distance equal to 10 feet plus one and one-half times the depth from the natural ground surface to the top of the consolidated material or materials. (c) No operator shall deposit soil material or locate any part of the surface mining and reclamation operations or waste accumulations outside the permit area. (Source: P.A. 81-1015.)
