§ 82609. Mechanical Restraints.

Mechanical restraints shall not be applied to a patient unless it is

determined by the treating qualified mental health professional person to be

required by the medical needs of the patient, and the use thereof is approved

by the court, or, in the case of an emergency, within 72 hours after restraints

are first used. Every use of mechanical restraints and the reasons therefor

shall be made part of the clinical record of the patient.
