§ 5204. Exceptions.
(a) An employer shall accommodate a known disability of an employee
or applicant for employment unless the employer demonstrates that the
accommodations would impose an undue hardship in the conduct or
business.
(b) This Chapter shall not apply to the employment of any individual by
a parent, spouse or child or of an individual in domestic service, or where, as
part of his or her employment, the individual resides in the personal
residence of the employer or renders a personal service to the employer or
members of his or her family.
(c) This Chapter shall not apply to the use of qualifications based upon
disability when the qualification is a bona fide occupational qualification,
certified by the Office of Equal Employment Opportunity in advance of the
use. The exceptions permitted in this Section based on bona fide
occupational qualifications shall be strictly construed.
