§ 49113. Emergency Orders.

CH 49 AIR POLLUTION CONTROL ACT

(a) Notwithstanding any other law, if the Administrator

determines that a pollution source or combination of sources is

creating an imminent and substantial endangerment to the public

health, welfare or the environment, the Administrator, with the

concurrence of the Governor, shall order any person causing, or

contributing to the release of any air pollutants or combination of

air pollutants, to immediately reduce or discontinue the release.

Any order under this Section shall fix a place and time, not later

than seventy-two (72) hours thereafter, for a hearing to be held

before the Agency.

(b) If the Administrator finds that emissions from the

operation of one (1) or more air pollution sources is causing

imminent danger to human health or safety, he or she may order

the person responsible for the operation in question to

immediately reduce or discontinue emissions, without regard to

the provisions of § 49111 of this Chapter. In such event, the

requirements for hearing set forth in Subsection (a) of this Section

shall apply.

(c) Nothing in this Section shall be construed to limit any

power, which the Governor or any other officer may have to

declare an emergency and act on the basis of that declaration, if

that power is conferred by statute or constitutional provision, or

inheres in the office.
