§ 3408. After-Acquired Shares.

A dissenter who was not the beneficial owner of the shares before the

date set forth in the dissenters' notice as the date of the first announcement

to news media or to stockholders of the terms of the proposed corporate

action waives his right to demand payment with respect to such shares

under § 3301 through § 3502 of this Chapter, unless the plan of merger or

share exchange expressly provides for such payment.
