§ 32128. Penalties.

(a) Any person who, with intent to avoid, evade or prevent

compliance, in whole or in part, with the provisions of this

chapter, removes from any place, conceals, or withholds any

documentary material or merchandise or sample of merchandise

in violation of a court order to produce the same is guilty of a

misdemeanor and on conviction is punishable by a fine of not

more than Five Thousand Dollars ($5,000) or by confinement in

prison for not more than one (1) year, or by both.

(b) Any person who, with intent to avoid, evade or prevent

compliance, in whole or in part, with the provisions of this

chapter, destroys, mutilates, alters, or by any other means falsifies

any documentary material or merchandise or sample of

merchandise is guilty of a felony of the third degree and on

conviction is punishable by a fine of not more than Fifty Thousand

Dollars ($50,000) or by confinement in prison for not more than

five (5) years, or by both.

(c) If a person fails to comply with a directive of the Attorney

General under this chapter or with a civil investigative demand for

documentary material served on him under this chapter, or if

satisfactory copying or reproduction of the material cannot be

done and the person refuses to surrender the material, the Attorney

General may file in a petition for an order of the court for

enforcement of the appropriate sections of this chapter.

(d) When a petition is filed, the court shall have jurisdiction

to hear and determine the matter presented and to enter any order

required to carry into effect the provision of this chapter. Failure

to comply with any order entered by the court pursuant to this

chapter is punishable by con tempt as well as any other penalty

specified.
