§ 31. Abortion.

(a) Abortion means the termination of a human pregnancy

with an intention other than to produce a live birth or to remove a

dead fetus.

(b) An abortion may be performed:

(1) by a physician licensed to practice medicine this

Territory or by a physician practicing medicine in the employ

of the government of the United States;

(2) in the physician’s adequately equipped medical

clinic or in a hospital approved or operated by the United

States or this Territory; and

(3) (A) within 13 weeks after the commencement of

the pregnancy; or

(B) within 26 weeks after the commencement of

the pregnancy if the physician has reasonably

determined using all available means:

(i) that the child would be born with a grave

physical or mental defect; or

(ii) that the pregnancy resulted from rape or

incest; or

(C) at any time after the commencement of

pregnancy if the physician reasonably determines using

all available means that there is a substantial risk that

continuance of the pregnancy would endanger the life of

the mother or would gravely impair the physical or

mental health of the mother.
