§ 120. Motion to Withdraw Plea: When Permitted.
A motion to withdraw a plea of guilty or nolo contendere may
be made only before sentence is imposed or imposition of sentence
is suspended; but to correct manifest injustice the court after
sentence may set aside the judgment of conviction and permit the
defendant to withdraw his plea.
NOTE: Section 120.42 is identical to former Rule 32(d). See also Fed. R.
