§ 20125. When Judge is to Assess Damages to the Defendant.

If the judgment is in favor of the defendant and it appears that the

arrest was wrongful or without sufficient cause, the plaintiff, upon order of

the court, and in addition to the payment of all costs which may be adjudged

to the defendant shall indemnify the defendant for all damages he may

sustain by reason of such arrest but such damages shall not be less than one

hundred dollars ($100.00).
