§ 4703. Sexual Harassment Defined.
For purposes of this Article, “sexual harassment” shall include:
(a) sexual harassment as defined by the federal Equal Employment Opportunity Commission;
(b) unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct
of a sexual nature when:

(1) submission to such conduct was made, either explicitly or implicitly, a term or condition
of an individual’s employment;
(2) submission to or rejection of such conduct by an individual was used as the basis for
employment decisions affecting such individual; or
(3) such conduct has the purpose or effect of unreasonably interfering with an individual’s
work performance or creating an intimidating, hostile, or offensive working environment;
(c) conduct that includes the use denotatively or connotatively defined sexual language that
includes, but is not limited to, profanity, offensive language and expletives, derogatory comments or
sexually offensive speech which is used to berate, bully, discipline or intimidate employees.
