§ 4201. Removal Generally.

(a) No person in the classified service shall be removed except for such cause as will promote the

efficiency of the service and for the reasons given in writing. The person whose removal is sought shall

have notice of the same and of any charges preferred against him, and be furnished with a copy thereof,

except as provided in § 4106 of this Chapter, and also be allowed a reasonable time for personally answering

the same in writing with affidavits in support thereof; provided, however, that this Section shall not apply

to persons whose employment is purely temporary, seasonal, intermittent, part-time or only for a specific

project.

(b) Nothing in this Section shall permit an employee to have redetermined by the Commission any

matter which, having been finally judicially determined is grounds, in law or personnel rule, for removal

from the government service.
