§ 3578. The employee organization recognized or certified as the exclusive representative
The employee organization recognized or certified as the exclusive representative shall represent all employees in the unit, fairly and impartially. A breach of this duty shall be deemed to have occurred if the employee organizationâs conduct in representation is arbitrary, discriminatory, or in bad faith.
