§ 5-36-404. Unlawful removal of a theft detection device.

A person commits the offense of unlawful removal of a theft detection device if the person knowingly removes a theft detection device from merchandise prior to purchase with the intent to commit theft or retail theft. The unlawful removal of a theft detection device is a Class A misdemeanor. A subsequent violation of this section is a Class D felony.
