§ 4-101-201. Duty of merchant — Penalty.

A person engaged in the business of selling fracture-filled or clarity-enhanced diamonds or jewelry containing fracture-filled diamonds shall: Disclose to the customer that the diamond has been treated and that it is a fracture-filled or clarity-enhanced diamond; and Post the following notice in a conspicuous place at the entrance to the premises: A violation of this section shall be a Class B misdemeanor. “NOTICE TO CUSTOMERS. Fracture-filled and clarity-enhanced diamonds are sold by this business. Arkansas law requires that the seller disclose to the customer that a diamond is fracture-filled or clarity-enhanced before the sale of any fracture-filled or clarity-enhanced diamond.”
