§ 14-386-401. Penalty for animals running at large — Damages.

If a majority of the qualified electors voting in an election held under the provisions of this subchapter shall approve the creation of the proposed fencing district, the district shall be held and deemed to be enclosed by a good and lawful fence, and it shall be unlawful for any person who is the owner, or who has control, of any kind of stock to let them run at large in the district. Any person violating the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction shall be fined in any sum not less than one dollar ($1.00) or more than fifty dollars ($50.00). In addition to the fine, an offender shall be liable for double the amount of any damages that any person may sustain by reason of his stock running at large in the district, to be recovered by action before any court of competent jurisdiction. This section shall not prohibit any person from fencing his lands, or any part of them separately, and pasturing them.
