§ 46.4902. Administrative malfeasance.
(a) A person who misappropriates, misuses, or unlawfully withholds or converts to his or her own use or to the use of another any public funds made available for the American Samoa Department of Human and Social Services Special Supplemental Food Program for Women, Infants and Children (WIC) and/or the American Samoa Department of Human and Social Services American Samoa Nutrition Assistance Program (Food Stamp) is guilty of a violation of this section and shall be punished as provided in section 46.4904. (b) An official or employee of the American Samoa Government who facilitates, aids, abets, assists or knowingly participates in a violation of this Chapter is guilty of a violation of this section and shall be punished as provided in section 46.4904. (c) An official or employee of the American Samoa Government who willfully fails to report a known violation of this chapter to the designated personnel as identified in the policy and procedures of the American Samoa Department of Human and Social Services, or the Attorney General, is subject to disciplinary proceedings under the rules of the applicable American Samoa Government agency.
