§ 45.0304. Petition for protection from child abuse.

(a) Upon receipt of a report filed by a law enforcement agency, an employee of a public or private school, or any person required to report under 45.2002, indicating that a child has suffered abuse as defined in subsection (a) of 45.2001 and that the best interest of the child require that he be protected from risk of further abuse, the Court shall then authorize and may order the filing of a petition. (b) Upon receipt of a report, as described in subsection (a), from any person other than those specified in subsection (a), the Court, after the investigation as may be reasonable tinder the circumstances. may authorize and may order the filing of a petition.
