§ 24.0140. Variance

(a) Except as provided in subsection (c), any person who owns or is in control of any plant, building, structure, establishment, process, or equipment may apply to the Commission for a variance from rules or regulations. (b) A variance, or a renewal of a variance, shall not be a right of the applicant or holder thereof but shall be in the discretion of the Commission. (c) A person shall not apply for, nor shall the Commission grant, a variance from any federal requirement or from any of the stationary air pollution source permit program rules or regulations adopted pursuant to 24.0115 and this chapter.
