§ 20.1114. Wharf damage.
It shall be the responsibility of the owner, master, or owner’s agent to provide any necessary protection to the wharves used, to protect them from all damage in excess of fair wear and tear, whether caused by unusual weather, wind, or operations of the vessel. Any damage caused by any vessel shall be reimbursed to the government prior to the vessel’s departure. A person aggrieved by a fine levied under the provisions of this subsection by the Port Director may appeal the matter to the High Court of American Samoa where the matter will be tried de novo. Amendments: 1980 Amended to conform with penalties provided for in Title 46, Criminal Justice. *1986 Amended to upgrade violations to a class D felony.
