§ 12.0212. Small or open purchase
(a) A procurement not exceeding the amount established by rule may be made in accordance with small purchase procedures promulgated by the Chief Procurement Officer. Procurement requirements may not be artificially divided so as to constitute a small purchase under this section. (b) A contract may be awarded for construction, goods, or services without competition when, under rules promulgated, the Chief Procurement Officer determines in writing that there is only one source for the required construction, goods, or services. (c) A contract may be awarded by negotiation when it is determined in writing that conditions are not appropriate for the use of competitive bidding in accordance with standards and procedures established by the rules.
