§ 45.0343. Certification hearing

(a) In a hearing as provided in 45.0340, if the court finds that it should certify the child for criminal proceedings as an adult, it shall enter an order to that effect; except, that, the order shall be null and void if the Attorney General fails to file any information in the Court within 5 days of issuance of the written order of certification, exclusive of Saturdays, Sundays, and Court holidays. Upon failure of the Attorney General to file any information, the Court retains jurisdiction and proceeds under 45.0330 to 45.0335. (b) As a condition of the certification, the Court in its discretion may provide that a child continues to be held in detention pending the filing of any information in the Court. Where the child has made bond in proceedings in the Court, it continues in full force and effect unless modified by order of the Court.
